Kalāvilāsa. and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

INDEMNITY

By use of this Site, you agree to indemnify and hold Kalāvilāsa (and its members) harmless from any claim or demand, as well as losses, expenses, damages and costs, resulting from any violation of these terms of service or any activity related to your account.

CREDIT/DEBIT CARD PARTICULARS

You understand, approve and confirm the accuracy of credit/debit card details provided by you for using our services on our website. Credit cards should be your own and should include correct and valid details. The info given by you will neither be used nor shared by us with any third party unless necessary for scam proofs by the law’s guideline or order of the court. We cannot be held responsible for any credit card fraud. You will be responsible for potential credit card fraud. The duty to prove wrong doing shall be solely on you.

RISK OF LOSS

All items purchased from Kalavilasa.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

APPLICABLE LAW

By visiting Kalavilasa.com, you agree that the laws of India, under the jurisdiction of the Bangalore High Court, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Kalavilasa.com or its affiliates.

DISPUTES

Any dispute relating in any way to your visit to Kalavilasa.com or to products you purchase through Kalavilasa.com shall be submitted to confidential arbitration in Bangalore, India, except that, to the extent you have in any manner violated or threatened to violate Kalavilasa.com intellectual property rights, Kalavilasa.com may seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

DISCLAIMER

Although we have taken all kinds of security measures for the protection of personal information, we cannot guarantee complete protection. You provide all personal information at your own risk.

We are making every possible effort to produce our products as perfectly as possible. What you will observe on the website is a view that results in the discrepancy of every computer screen - like colors, shades, textures, sizes and appearances etc. A customer may request photographs of products other than the ones displayed online by sending an email at info@kalavilasa.com

▪ We firmly believe in your privacy and the security of your personal information. We do not rent, sell or distribute our customer base or newsletter e-mails to anyone. We only send our newsletters to email addresses that have opted in, and they may opt out at any time. If you place an order with us, we send email messages pertaining to your order. We do not sell your email address to other parties.

▪ We also do not store your credit card details on our server, all credit card purchases are processed through our secure payment gateway. Your privacy is important to us.

▪ We collect your personal information when you provide it to us as you place your order, including your name, shipping and billing address, and email address. We use this information to process your order, provide you with support, and update you on your order. We do not sell your personal information to other parties.

▪ We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

DOMESTIC SHIPPING AND RETURNS (INDIA)

SHIPPING

All orders go through a stringent quality check before shipping. However, in the off chance that you have received a damaged product, please notify us at info@kalavilasa.com along with photos of the damaged product, within 24 hours of receiving the order.

▪ Processing the order of the Ready-to-ship dhurries within India takes 1 working day and is delivered within 6-10 working days.

▪ Made-to-order and Custom-made dhurries are produced within 4-6 weeks after the order is placed, and are shipped immediately.

▪ Once the order is successfully placed, you will receive the notifications via email.

▪ Listed Prices are final and inclusive of all duties and taxes to be paid in India.

▪ We offer free shipping in India on every order above ₹5000 purchased through our website.

▪ For every order worth ₹5000 or below, a flat rate of ₹250 is charged for shipping.

▪ India Post is the most reliable logistics service provider in Hatwa. We use it's services to dispatch the goods in India and abroad.

RETURN

Before you return a Kalāvilāsa product, please take a moment to understand how our products are made. All our products are hand woven by traditional artisans using natural yarns, resulting in each product being unique and slightly different from each other. All the processes are manual; hence the irregularities which may occur are characteristic of the process and not counted as a defect.

▪ The product bought will only be accepted for return if you have received a damaged product, and will be replaced only when notified to info@kalavilasa.com along with its photos, within 24 hours of receiving the order.

▪ We do not offer Refunds.

▪ The Kalāvilāsa team holds the right to not accept returns in case the product is used or damaged by the customer.

▪ Returns are not accepted for Discounted/Sale products.

▪ Any parcel which is returned to us without a prior email notice will not be accepted.

INTERNATIONAL SHIPPING & RETURNS

Dhurries are shipped internationally. As the dhurries are heavy, they are shipped using the reliable, inexpensive, but a tad slow service of India Post. Please allow up to 2-3 weeks for your package to arrive. Some areas may take longer depending on customs. Due to the nature of international shipping, occasionally a customer may have to pay additional import duties and taxes which are levied once a shipment reaches your country. The large majority of orders will not have to pay any additional fees. However, we are unable to calculate when and how much these infrequent customs duty charges will be levied. Payment of customs duty, if any, is the responsibility of the buyer. In the case where additional customs charges are assessed, you will be responsible for paying these additional fees.

REFUND AND CANCELLATION POLICY

▪ We do not offer refunds on Shipped/Delivered orders.

▪ Order cancellation will only be accepted before the shipment has been dispatched. A nominal fee of ₹500 will be charged for cancellation. You can cancel your order by sending a WhatsApp message on +91 9845205420 or by sending an email to us at - info@kalavilasa.com

▪ Once the order is canceled, the cancellation fee of ₹500 will be deducted from the amount paid, and a refund shall be initiated for the remaining amount and it should reflect in your account within 48 business hours through the original mode of payment.
